10月22日，区块链Truth发表了题为《追踪徐明星》的深度长文，对OKEx部分用户的维权事件进行了报道。文章发出后，很快被腾讯、新浪、凤凰等主流门户转载，引起了行业内外的关注。

OKCoin和OKEx究竟是什么关系？

中国互联网金融协会申诉委员、北京大成律师事务所合伙人肖飒在接受区块链Truth采访时称，判断两家公司是否为一家公司，要看这两个公司是否为独立法人，如果两家公司实际上为一家公司，可以形象地理解为“一套人马，两块牌子”。鉴定标准可以从公司是否拥有独立财产、公司的实际控制人是否相同、公司的大股东是否相同、两个公司是否各自独立地承担权利义务等方面判断。

2017年9月4日，央行等七部委联合发布《关于防范代币发行融资风险的公告》，要求各类代币发行融资活动立即停止。

针对区块链领域“国外注册、国内运营”的公司，肖飒称，司法机关目前主要关注的是在我国境内是否有“实质经营的行为”，即便是在国外注册，但是如果在国内有实质经营的行为，则属于代币融资行为。国家相关部门发布的《关于代币融资风险公告》中，对代币融资活动性质做出了界定——涉嫌非法发售代币票券、非法发行证券以及非法集资、金融诈骗、传销等违法犯罪活动。
