1.我国有专门的《中华人民共和国引渡法》
We have a special Extradition Law of the People's Republic of China .
早在18年前,我国就发布并实施了《中华人民共和国引渡法》,对于向我国请求引渡及向外国请求引渡的条件、提出、审查、强制措施等作出了规定。可谓有法可依,并非空白。
Eighteen years ago, our country promulgated and implemented the Extradition Law of the People's Republic of China, which provides for conditions, offers, reviews, enforcement measures, etc. for extradition requests to our country and requests for extradition to foreign countries.
我国与外国之间的引渡,通过外交途径联系,指定了外交部为进行引渡的联系机关。
Extradition between our country and a foreign country is carried out through diplomatic contacts, and the Ministry of Foreign Affairs is designated as the focal point for extradition.
办理引渡案件,可以根据情况,对被请求引渡人采取引渡拘留、引渡逮捕或者引渡监视居住等强制措施。
In extradition cases, coercive measures such as extraditing detention, extraditing arrest or monitoring residence may be imposed on the person sought, depending on the circumstances.
根据引渡法,是否引渡由国务院决定,国务院在必要时,得授权国务院有关部门决定。因此,引渡的决定机关是国务院,联络机关为外交部。
According to the extradition law, extradition is decided by the State Council, which may, if necessary, authorize the relevant department of the State Council to decide. Therefore, the decision-making body for extradition is the State Council and the liaison body is the Ministry of Foreign Affairs.
2.在外国犯事,跑回国内

诚然,自去年9月4日之后,不少币圈和链圈的团队“出海”,目的地国丰富多彩,远至非洲近到日本,还有新加坡、蒙古、立陶宛、越南等等。从大陆法系国家到判例法系国家都有,还有横跨几个国家进行技术和运营合作的情形。
Indeed, since 4 September last year, a number of currency and chain teams have gone “out to sea” and destination countries are rich, as far as Africa is close to Japan, Singapore, Mongolia, Lithuania, Viet Nam, and so on. From civil law to case law countries, there are cases of technical and operational cooperation across several countries.
外国的行政法规和政策都在更迭变化,如果触及相关法律,行为人还在我国境内,那么会不会被引渡到国外呢,某些国家可是有“鞭刑”的。
Foreign administrative regulations and policies are changing, and if the relevant laws are touched upon and the perpetrators are still in our territory, they will not be extradited abroad, and in some countries there will be “lashes”.
根据我国法律规定,引渡请求所指的行为,依照我国法律和请求国法律均构成犯罪,也就是说,行为人的行为必须同时触犯两国法律。在金融犯罪领域,多数还是恐怖融资及洗钱类犯罪,还有部分诈骗类犯罪。
Under our laws, the acts referred to in the request for extradition constitute offences under our laws and the laws of the requesting State, that is, the perpetrator must act simultaneously in violation of the laws of both countries. In the area of financial crimes, the majority are also crimes such as terrorist financing and money-laundering, as well as some fraud offences.
我国有权拒绝引渡国的引渡请求,只要引渡人具有中国国籍。也就是说,外籍华人有可能被引渡,只拥有外国绿卡、工作签证的中国人,不会被引渡。
We have the right to refuse a request for extradition from an extraditing country, provided that the person is of Chinese nationality. That is to say, a foreign Chinese national may be extradited and a Chinese national with only a foreign green card and a work visa will not be extradited.
3.在我国犯事,跑到国外

如果在我国境内犯罪,潜逃到国外,我国可以向外国请求引渡。
If a crime is committed in our territory and absconds abroad, we can request extradition from a foreign country.
只有省级、自治区、直辖市的公检法及国家安全、监狱管理机关才能向最高法、最高检、公安部、司法部提出引渡意见书。也就是说,县、市的中院和基层法院没有提出引渡意见书的法定权力。
Only provincial, autonomous and municipal public prosecution laws, as well as national security and prison administration authorities, may submit an extradition opinion to the Supreme Court, the Supreme Court, the Ministry of Public Security and the Ministry of Justice.
当然,最终向外国提出引渡请求,还是由外交部具体进行的。
Of course, the final request for extradition to a foreign State is made specifically by the Ministry of Foreign Affairs.
如果被请求国就准予引渡“附加条件”的,这里的附加条件,一般指的是“限制追诉”(由最高检决定)、“量刑承诺”(由最高法决定),也就是影响案件的走向的要求。如果不损害我国主权、国家利益、公共利益,外交部可以代为作出承诺。
If the requested State is granted “conditions” for extradition, the conditions attached here generally refer to “restriction of recourse” (to be determined by the Supreme Court), “commitments to sentence” (to be determined by the Supreme Court), i.e. requirements that affect the course of the case. If it does not undermine the sovereignty, national interests, or the public interest of the country, the Ministry of Foreign Affairs may make commitments on its behalf.
同时,公安机关负责接收外国准予引渡的人以及与案件有关的财物。也就是说,如果对于扣押、冻结财产有异议的,行为人及其律师还是要跟公安机关进行申请和沟通。
At the same time, the public security organs are responsible for receiving the extradition of persons granted by a foreign State and the property related to the case. In other words, if there is an objection to the seizure or freezing of property, the perpetrator and his or her lawyer are required to apply and communicate with the public security authorities.
请注意,紧急情况下,我国政府会通过国际刑警组织对被引渡人采取临时强制措施。
Please note that, in emergency situations, my Government, through INTERPOL, will take temporary coercive measures against extradited persons.
4.关于遣返
4. On repatriation
国际上并无统一的遣返规则,我们以咱们国家的遣返规定为例,进行研究。
There are no uniform rules for repatriation at the international level, and we are looking at repatriation provisions in our country, for example.
根据2013年生效的《中华人民共和国出境入境管理法》,外国人有下列情形之一的,可以遣送出境:
According to the Law of the People's Republic of China on the Administration of Exit and Entry into the Territory, which entered into force in 2013, aliens may be deported if:
(一)被处限期出境,未在规定期限内离境的;
(i) if he has not left the country within the prescribed time limit;
(二)有不准入境情形的;
(ii) In case of non-admission;
(三)非法居留、非法就业的;
(iii) Illegal residence, illegal employment;
(四)违反本法或者其他法律、行政法规需要遣送出境的。
(iv) If deportation is required in violation of this or other laws and administrative regulations.
其他境外人员有前款所列情形之一的,可以依法遣送出境。
If any other person outside the country has one of the circumstances listed in the preceding paragraph, he or she may be removed by law.
请注意,自遣送出境之日起,一至五年内不准入境。
Please note that entry into the country is not permitted for a period of one to five years from the date of removal.
上述规定虽然是我国对于外国人的遣返规定,但是在一定程度上也可以起到借鉴的作用,进而了解他国遣返程序。
Although the above-mentioned provisions are our national provisions on the repatriation of aliens, they may also serve to some extent as a basis for understanding the procedures for the return of aliens from other countries.

The People's Republic of China and the Republic of Korea (hereinafter referred to as “the Parties”),
愿意在互相尊重主权和平等互利原则的基础上,通过缔结引渡条约,更为有效地促进两国在预防和打击犯罪方面的合作,
Desiring to promote more effectively cooperation between the two countries in preventing and combating crime through the conclusion of extradition treaties, based on mutual respect for the principles of sovereignty and equality and mutual benefit,
达成协议如下:
Have agreed as follows:
第一条 引渡义务
Article 1 Obligation to extradite
任何一方有义务根据本条约的规定,应另一方请求,相互引渡在其境内发现的被另一方通缉的人员,以便就可引渡的犯罪进行追诉、审判或者执行刑罚。
In accordance with the provisions of this Treaty, any party is under an obligation to extradite to one another, at the request of the other party, persons found in its territory by the other party who are wanted by the other party for the purpose of pursuing, trying or executing a sentence for an extraditable offence.
第二条 可引渡的犯罪
Article 2 Extraditable offences
一、在本条约中,可引渡的犯罪是指在提出请求时,根据双方法律可处以至少一年有期徒刑或者更重刑罚的犯罪。
1. For the purposes of this Treaty, an extraditable offence is an offence punishable by at least one year's imprisonment or a heavier penalty under the laws of both parties at the time of the request.
二、如果引渡请求所针对的人员已被请求方法院就可引渡的犯罪判处有期徒刑,则只有在提出请求时,尚未服完的刑期至少为六个月的情况下,才应准予引渡。
2. If the person against whom the extradition request is made has been sentenced by the court of the requesting party to a term of imprisonment for the extraditable offence, extradition shall be granted only if, at the time of the request, the sentence not yet served is at least six months.
三、为本条的目的,在决定某一犯罪是否构成违反双方法律的犯罪时:
3. For the purposes of this article, in determining whether an offence constitutes an offence against the laws of both parties:
(一)不应考虑双方法律是否将构成该犯罪的行为列入同一犯罪种类,或者是否对该罪行规定同一罪名;
(i) It shall not be considered whether the acts constituting the offence are included in the same category of offences under the laws of both parties or whether the offence is covered by the same offence;
(二)应对被请求引渡人受到指控的行为作整体考虑,而不论根据双方法律该犯罪的构成要件是否存在差别。
(ii) The conduct alleged against the person whose extradition is requested shall be considered as a whole, regardless of whether there is a difference in the constituent elements of the offence under the laws of both parties.
四、如果引渡请求系针对违反有关赋税、关税、外汇管制或者其他税务事项的法律的犯罪,被请求国不得以其法律没有规定同类的赋税或者关税,或者没有规定与请求国法律同样的赋税、关税或者外汇管制条款为理由拒绝引渡。
4. If the extradition request is an offence against the law relating to taxation, customs duties, foreign exchange controls or other tax matters, the requested State may not refuse extradition on the grounds that its law does not provide for taxes or customs duties of the same kind, or does not provide for the same tax, customs or exchange control provisions as the law of the requesting State.
五、如果引渡请求涉及若干犯罪,每项犯罪根据双方法律均应受到处罚,但其中某些犯罪不符合本条第一款或者第二款规定的条件,只要该人因犯有至少一项可引渡的罪行将被引渡,则也可就这些犯罪准予引渡。
5. If the request for extradition relates to a number of offences, each of the offences shall be punishable under the laws of both parties, provided that certain of the offences do not meet the conditions set forth in paragraph 1 or 2 of this article and that extradition may also be granted for those offences if the person will be extradited for the commission of at least one extraditable offence.
第三条 应当拒绝引渡的理由
Article 3 Grounds on which extradition should be refused
有下列情况之一的,根据本条约不应当准予引渡:
Extradition shall not be granted under this treaty if:
一、被请求方认为引渡请求所针对的犯罪是政治犯罪。政治犯罪不应包括谋杀、或者企图谋杀或者是伤害国家元首、政府首脑、或者其家庭成员;
The requested party considers the offence for which the extradition request is made to be a political offence.
二、被请求引渡人已在被请求方境内因引渡请求所针对的犯罪受到审判并被判定有罪或者无罪;
2. The person whose extradition is requested has been tried and convicted or acquitted of the offence for which the extradition request was made in the territory of the requested party;
三、根据任何一方法律,被请求引渡人因包括时效在内的各种原因,被免予追诉或者执行刑罚;
The person whose extradition is requested is exempted from prosecution or execution of the penalty for various reasons, including the statute of limitations, in accordance with the law of either party;
四、引渡请求所针对的犯罪为军事犯罪,并不构成普通犯罪;
The offence for which the extradition request is made is a military offence and does not constitute an ordinary offence;
五、被请求方有充分理由认为,请求引渡的目的是基于被请求引渡人的种族、性别、宗教、国籍或者政治见解等原因而对该人予以追诉或者处罚,或者该人的地位将会因为上述任何原因受到损害。
The requested party has substantial grounds for believing that the purpose of the request for extradition is to prosecute or punish the person sought for reasons of race, sex, religion, nationality or political opinion, or that the person's position would be prejudiced for any of the above reasons.
第四条 可以拒绝引渡的理由
Article 4 Grounds on which extradition may be refused
有下列情形之一的,根据本条约可以拒绝引渡:
Extradition may be refused under this treaty if:
一、被请求方主管机关已决定不对被请求引渡人就引渡请求所针对的犯罪提起诉讼,或者已经决定终止诉讼;
1. The competent authorities of the requested Party have decided not to prosecute the person sought for the offence for which the extradition request is made, or have decided to terminate the proceedings;
二、被请求方正在对被请求引渡人就引渡请求所针对的犯罪进行追诉;
The requested party is in the process of pursuing the person sought in respect of the offence for which the extradition request is made;
三、引渡请求所针对的犯罪发生在请求方领土外,而被请求方法律在类似情形下没有对这种犯罪规定管辖权;
The offence for which the request for extradition is made is committed outside the territory of the requesting party and the law of the requested party does not provide for jurisdiction over such offence in similar circumstances;
四、根据被请求方法律,引渡请求所针对的犯罪被认为全部或者部分发生在该方境内。被请求方如果基于此种理由拒绝引渡,则须应对方的请求,将案件提交其主管机关,以便就引渡请求所针对的犯罪采取适当措施;
4. According to the law of the requested party, the offence for which the extradition request is made is considered to have been committed in whole or in part in the territory of that party. If the requested party refuses extradition on such grounds, it must, at the request of the requested party, submit the case to its competent authorities in order to take appropriate measures in respect of the offence for which the request is made;
五、被请求方在考虑罪行的严重性和请求方利益的同时,认为由于被请求引渡人的个人原因,引渡不符合人道主义考虑。
5. The requested party, taking into account the gravity of the offence and the interests of the requesting party, considers that extradition is incompatible with humanitarian considerations for personal reasons of the person sought.
第五条 国民的引渡
Article 5 Extradition of nationals
一、双方有权拒绝引渡其本国国民。
1. Each Party shall have the right to refuse the extradition of its nationals.
二、如果根据本条第一款不准予引渡,被请求方应根据请求方的请求,将案件提交其主管机关,以便在其本国法律允许的范围内予以追诉。为此,请求方应向被请求方提交与案件有关的文件和证据。
2. If extradition is not granted in accordance with paragraph 1 of this article, the requested party shall, at the request of the requesting party, submit the case to its competent authorities for the purpose of prosecution to the extent permitted by its domestic law. To that end, the requesting party shall submit to the requested party documents and evidence relevant to the case.
第六条 联系途径
Article 6. Channels of communication
为本条约的目的,双方应当通过外交途径相互联系,但本条约另有规定的除外。
For the purposes of this Treaty, the Parties shall communicate through diplomatic means, except as otherwise provided in this Treaty.
第七条 引渡请求和所需文件
Article 7. Extradition request and required documents
一、引渡请求应当以书面方式通过外交途径提出,并包括或者附有下列材料:
1. The request for extradition shall be made in writing and through diplomatic means and shall include or be accompanied by:
(一)请求机关的名称;
(i) The name of the requesting authority;
(二)足以确定被请求引渡人身份、国籍以及可能时该人所在地点的文件;
(ii) A document sufficient to establish the identity, nationality and, if possible, location of the person sought;
(三)案件事实的说明;
(iii) A description of the facts of the case;
(四)关于所犯罪行的罪名以及处罚的法律的说明;
(iv) A description of the law on the offences committed and the penalties imposed;
(五)关于追诉罪行或者执行刑罚之时效的法律的说明。
(v) A description of the law relating to the prosecution of the offence or the statute of limitations for the execution of the penalty.
二、如果引渡请求针对尚未被判定有罪的人员,则应当附有由请求方法官或者其他主管机关签发的逮捕证的副本。
2. If the request for extradition is directed against a person who has not yet been convicted, it shall be accompanied by a copy of the arrest warrant issued by the judge or other competent authority of the requesting party.
三、如果引渡请求针对已被判刑的人员,则应当附有下列材料:
3. If the extradition request is directed against a sentenced person, it shall be accompanied by the following information:
(一)请求方法院作出的终局判决的副本;
(i) A copy of the final judgement rendered by the court of the requesting party;
(二)必要时,已经执行刑期的说明。
(ii) If necessary, a statement that the sentence has been served.
四、为支持引渡请求而提供的所有文件应经证明无误,并附有被请求方文字或者英文的译文。
4. All documents provided in support of the extradition request shall be certified as correct, with either the language of the requested party or a translation into English.
五、为本条约的目的,下列文件应属已证明无误:
5. For the purposes of this Treaty, the following documents should be proved to be correct:
(一)该文件已由请求方的法官或者其他官员签署或者证明;
(i) The document has been signed or certified by a judge or other official of the requesting party;
(二)该文件已由请求方主管机关正式盖章。
(ii) The document has been duly stamped by the competent authorities of the requesting Party.
第八条 补充材料
Article 8 Supplementary information
一、如果被请求方认为,为支持引渡请求所提供的材料不足以使其根据本条约准予引渡,该方可以要求在四十五天内提供补充材料。如果请求方提出合理要求,这一期限可以延长十五天。
If the requested party considers that the information provided in support of the extradition request is insufficient to enable it to grant extradition under this treaty, it may request additional information within 45 days.
二、如果被请求引渡人已被逮捕,而且被请求方在本条第一款所指的期限内,没有收到其所要求的补充材料,则可以释放该人。此种释放不应妨碍请求方重新提出引渡该人的请求。
2. The person whose extradition is requested may be released if he or she has been arrested and the requested party has not received the additional information requested by him or her within the period referred to in paragraph 1 of this article. Such release shall not prevent the requesting party from making a new request for his or her extradition.
三、如果已经根据本条第二款释放被请求引渡人,被请求方应当尽快通知请求方。
If the person sought has been released pursuant to paragraph 2 of this article, the requested party shall so inform the requesting party as soon as possible.
第九条 临时羁押
Article 9 - Temporary detention
一、在紧急情况下,一方可以请求另一方在收到引渡请求前临时羁押被请求引渡人。此种请求应当以书面方式通过外交途径提出,或者在中华人民共和国主管机关和大韩民国法务部之间提出。
1. In an emergency situation, one party may request the other party to keep the person sought in custody pending receipt of the request for extradition.
二、临时羁押请求应当尽量包括本条约第七条第一款所列内容,还需说明已经备有该条第二款或者第三款所列文件,并即将提出正式引渡请求。
2. Requests for provisional detention shall include, to the extent possible, the elements listed in article VII, paragraph 1, of this Treaty, together with an indication that the documents listed in paragraph 2 or 3 of that article have been made available and that a formal request for extradition will be forthcoming.
三、一经收到此种请求,被请求方如果同意该请求,则应当采取必要措施,以便羁押被请求引渡人。
3. Upon receipt of such a request, the requested Party shall, if it agrees to the request, take the necessary measures for the custody of the person whose extradition is requested.
四、被请求方应当将对此种请求的处理结果,尽快通知请求方。
The requested Party shall notify the requesting Party of the outcome of such request as soon as possible.
五、如果在羁押被请求引渡人后的三十天内,被请求方主管机关没有收到正式引渡请求,则应当解除临时羁押。如果请求方提出合理要求,这一期限可以延长十五天。
If the competent authority of the requested party does not receive an official request for extradition within thirty days of the person being detained, the provisional detention shall be lifted.
六、如果被请求方随后收到了正式引渡请求,根据本条第五款解除临时羁押,不应妨碍对被请求引渡人的引渡。
6. If the requested party subsequently receives a formal request for extradition, the lifting of the provisional detention pursuant to paragraph 5 of this article shall not prejudice the extradition of the person sought.
第十条 数个引渡请求
Article 10 Plurality of requests for extradition
一、被请求方如果收到两个或者更多国家针对同一人的相同或者不同犯罪提出的引渡请求,有权自主决定将该人引渡给哪一国,并应当将决定通知这些国家。
1. If the requested party receives a request for extradition from two or more States for the same or different offences committed by the same person, it shall have the right to decide in its own right to which State the person is to be extradited and shall inform those States of the decision.
二、在决定将该人引渡给哪一国时,被请求方应当考虑所有有关因素,包括但不限于下列因素:
2. In deciding to which State the person is to be extradited, the requested party shall take into account all relevant factors, including, but not limited to, the following:
(一)请求是否系根据条约提出;
(i) Whether the request is made under the treaty;
(二)被请求引渡人的国籍和经常居住地;
(ii) The nationality and habitual residence of the person sought;
(三)各项犯罪实施的时间和地点;
(iii) The time and place of the commission of the offences;
(四)罪行的严重性;
(iv) The seriousness of the offence;
(五)提出请求的日期。
(v) The date of the request.
第十一条 对于引渡请求的决定
Article 11 Decisions on requests for extradition
一、被请求方应当根据本国法律规定的程序处理引渡请求,并且迅速将决定通过外交途径通知请求方。
1. The requested Party shall process the request for extradition in accordance with the procedures provided for in its domestic law and promptly inform the requesting Party of its decision through diplomatic channels.
二、如果被请求方全部或者部分拒绝引渡请求,应当向请求方说明拒绝理由。
2. If the requested party rejects the request for extradition in whole or in part, the requesting party shall be informed of the reasons for the refusal.
第十二条 移交
Article 12 Transfer
一、如果被请求方同意引渡,则应当在双方同意的被请求方境内的地点,将被请求引渡人移交给请求方的适当机关。同时,被请求方应当将被引渡人在移交前已被羁押的时间通知请求方。
1. If the requested party agrees to extradition, the person sought shall be surrendered to the appropriate authority of the requesting party at the place in which the requested party is present, as mutually agreed. At the same time, the requested party shall notify the requesting party of the time that the person has been detained before surrender.
二、请求方应当在被请求方指定的合理期限内,将该人带离被请求方领土;如果该人在上述期限内未被带离,被请求方可以释放该人,并且可以拒绝就同一犯罪引渡该人。
2. The requesting Party shall remove the person from the territory of the requested Party within a reasonable period of time as designated by the requested Party and, if the person has not been removed within the said period, the requested Party may release the person and may refuse to extradite the person for the same offence.
三、如果一方由于不可控制的原因不能移交或者带离被引渡人,该方应当通知另一方。双方应当相互商定新的移交或者带离日期和地点,并且适用本条第二款的规定。
3. If one party is unable to surrender or remove the extradited person for reasons beyond its control, that party shall notify the other party. The parties shall agree between themselves on the date and place of the new surrender or removal and shall apply the provisions of paragraph 2 of this article.
第十三条 移交财物
Article 13 Transfer of property
一、如果请求方提出请求,被请求方应当在本国法律允许的范围内,扣押在其境内发现的犯罪所得、犯罪工具以及可作为证据的其他财物,并且在准予引渡的情况下,将该财物移交给请求方。
1. If so requested by the requesting Party, the requested Party shall, to the extent permitted by its domestic law, seize proceeds of crime, instrumentalities of crime and other property which may be evident in its territory and, if extradition is granted, surrender such property to the requesting Party.
二、如果准予引渡,即使因被请求引渡人死亡、失踪或者脱逃而不能执行引渡,本条第一款提到的财物仍可以移交。
2. If extradition is granted, the property referred to in paragraph 1 of this article may be surrendered even if the extradition cannot be carried out because of the death, disappearance or flight of the person sought.
三、被请求方为进行未决的其他追诉或者审判,可以推迟移交上述财物,直至诉讼终结,或者在请求方归还的条件下,临时移交该财物。
3. The requested party may defer the transfer of the said property for the purpose of pursuing other pending claims or trials until the completion of the proceedings or on a provisional basis under conditions to be returned by the requesting party.
四、移交此种财物不得损害被请求方或者任何第三者对该财物的合法权利。如果存在此种权利,请求方应当根据被请求方的请求,在诉讼终结之后,尽快将被移交的财物无偿返还被请求方。
4. The handing over of such property shall not prejudice the legitimate rights of the requested party or any third party in respect of the property. If such rights exist, the requesting party shall, at the request of the requested party, return the property transferred to the requested party without compensation as soon as possible after the proceedings have been completed.
第十四条 推迟移交和临时移交
Article 14 Postponement of transfer and provisional surrender
一、如果被请求引渡人正在被请求方因非引渡请求所针对的犯罪提起刑事诉讼或者服刑,被请求方可以在作出准予引渡的决定后,推迟移交该人直至诉讼终结或者服刑完毕。被请求方应当将推迟移交告知请求方。
If the person sought is in the process of initiating criminal proceedings or serving a sentence for an offence that is not the subject of the extradition request, the requested party may, after making a decision to grant extradition, defer the surrender of the person until the completion of the proceedings or completion of the sentence. The requested party shall inform the requesting party of the delay in surrender.
二、在已认定某人可以被引渡的情况下,被请求方可以在本国法律允许的范围内,根据双方商定的条件,将该人临时移交给请求方,以便进行追诉。请求方应当在有关诉讼终结后,立即将该人交还被请求方。在临时移交后又交还被请求方的人员,应当根据本条约的规定,被最终移交以便服刑。
2. Where it has been determined that a person may be extradited, the requested party may, to the extent permitted by its domestic law and subject to mutually agreed terms, temporarily surrender the person to the requesting party for the purpose of pursuing the prosecution. The requesting party shall return the person to the requested party immediately after the completion of the proceedings.
第十五条 特定规则
Article 15 Rules of particularity
一、根据本条约被引渡的人员,在请求方仅应因以下犯罪受到羁押、审判或者处罚:
1. A person extradited under this Treaty shall be detained, tried or punished in the requesting Party only for the following offences:
(一)准予引渡所针对的犯罪,或者基于同一事实而准予引渡但使用了不同罪名的犯罪,只要该项犯罪为可引渡的犯罪,或者是包括在可引渡的犯罪中的较轻犯罪;
(i) An offence for which extradition is granted, or an offence for which extradition is granted on the basis of the same facts but using a different offence, provided that the offence is extraditable or includes a lesser offence in the extraditable offence;
(二)该人在引渡后实施的犯罪;
(ii) An offence committed by that person after his or her extradition;
(三)被请求方同意对该人予以羁押、审判或者处罚所针对的犯罪;
(iii) The consent of the requested party to the detention, trial or punishment of the person for the offence for which he or she is the subject;
为本项的目的,
For the purposes of this subparagraph,
1、被请求方可以要求提供第七条所要求的文件;
1. The requested party may request the documents required under article 7;
2、如果被引渡人就该犯罪作出任何陈述,应当将陈述的法律记录提供给被请求方。
2. If the person extradited makes any statement about the offence, the legal record of the statement shall be made available to the requested party.
二、除非被请求方同意,根据本条约被引渡的人员不得因移交前实施的犯罪被引渡给第三国。
2. A person extradited under this treaty may not be extradited to a third State for an offence committed prior to surrender, unless the requested party so agrees.
三、在下列任何情况下,本条第一款和第二款不应妨碍对被引渡人予以羁押、审判或者处罚,或者将该人引渡给第三国:
3. Paragraphs 1 and 2 of this article shall be without prejudice to the custody, trial or punishment of an extradited person or to the extradition of that person to a third State if:
(一)该人在被引渡后,离开请求方领土又自愿返回;
(i) After his or her extradition, he or she leaves the territory of the requesting Party and returns voluntarily;
(二)该人在可以自由离开请求方领土之日起四十五天内没有离开。但是,该人由于无法控制的原因未能离开请求方领土的时间不应计算在此期限内。
(b) The person did not leave the territory of the requesting Party within forty-five days of the date on which he or she was free to leave the territory of the requesting Party. However, the period within which the person was unable to leave the territory of the requesting Party for reasons beyond his or her control shall not be counted.
第十六条 通报结果
Article 16 Communication of results
请求方应当及时向被请求方通报有关对被引渡人进行刑事诉讼、执行刑罚或者将该人再引渡给第三国的情况。
The requesting party shall promptly inform the requested party of the criminal proceedings, the execution of the sentence or the re-extradition of the person to a third State.
第十七条 过境
Article 17 Transit
一、任何一方经过另一方领土运送由第三国移交的人员时,如果通过外交途径提出书面请求,过境方在本国法律允许的范围内,应予许可。
1. When a person transferred by a third State is transported by either party through the territory of the other party, the transit party shall permit, to the extent permitted by its domestic law, a written request made through diplomatic channels.
二、如果使用航空运输并且没有在过境方领土降落的计划,则无需获得过境许可。如果在过境方领土内发生计划外的降落,该方可以要求另一方提出本条第一款规定的过境请求。
A transit permit is not required if an air transport is used and there is no plan to land in the territory of the transit party.
第十八条 费用
Article 18 Costs
一、被请求方应当承担在其领土内由引渡请求所引发的任何程序的费用。
1. The requested party shall bear the costs of any proceedings arising out of the extradition request in its territory.
二、被请求方应当承担在其领土内产生的、与扣押和移交财物或者逮捕和羁押被请求引渡人有关的费用。
2. The requested party shall bear the expenses incurred in its territory in connection with the seizure and transfer of property or the arrest and detention of the person sought for extradition.
三、请求方应当承担将被准予引渡的人员从被请求方领土带离所产生的费用以及过境费用。
The requesting party shall bear the costs incurred in removing the person whose extradition is granted from the territory of the requested party and the costs of transit.
第十九条 与其他条约的关系
Article 19 Relations with other treaties
本条约不应影响双方根据任何其他条约享有的权利和承担的义务。
This Treaty shall not affect the rights and obligations of the parties under any other treaty.
第二十条 协商
Article 20 Consultations
一、如果任何一方提出请求,双方应当尽快通过外交途径,就本条约的解释、适用或者执行事项进行协商。
1. If so requested by either Party, the Parties shall consult as soon as possible through diplomatic channels on matters relating to the interpretation, application or implementation of this Treaty.
二、中华人民共和国的主管机关和大韩民国法务部可以就办理个案的有关事项,相互直接协商。
The competent authorities of the People's Republic of China and the Ministry of Justice of the Republic of Korea may consult each other directly on matters relating to the handling of individual cases.
第二十一条 生效和终止
Article 21 Entry into force and termination
一、本条约需经批准。批准书在北京互换。本条约自互换批准书之日后第三十天生效。
1. This Treaty shall be subject to ratification. Instruments of ratification shall be exchanged in Beijing. The Treaty shall enter into force on the thirtieth day following the date of exchange of instruments of ratification.
二、任何一方可以随时通过外交途径,以书面形式通知终止本条约。终止自该通知发出之日后第一百八十天生效。本条约的终止不影响此前已经开始的引渡程序。
2. Any party may terminate this Treaty at any time by means of diplomatic notice in writing. Termination shall enter into force on the one hundred and eighty days following the date of such notification.
三、本条约适用于其生效后提出的任何请求,即使有关犯罪发生于本条约生效前。
3. This Treaty shall apply to any request made after its entry into force, even if the offence in question was committed prior to its entry into force.
下列签字人经各自政府正式授权,签署本条约,以昭信守。
IN WITNESS WHEREOF the undersigned, being duly authorized thereto by their respective Governments, have signed this Treaty.
本条约于二○○○年十月十八日订于汉城,一式两份,每份均以中文、韩文和英文写成,三种文本同等作准。如遇解释上的分歧,以英文本为准。
This Treaty, signed at Seoul on 18 October 2000, in two copies in Chinese, Korean and English, the three texts being equally authentic. In case of disagreement on interpretation, the English text shall prevail.
