以比特币为代表的虚拟货币在我国是合法存在的，被定义为一种特殊的互联网商品，民众在自担风险的前提下可以自由的买卖。但如果打着比特币的幌子进行传销诈骗活动那就是违法的。现在创建虚拟货币交易平台必须进行网站的备案，对用户实行实名认证。全球除了一些小国家明确禁止比特币以外，比特币在全球大多数国家都是合法存在的。
Virtual currency, represented by bitcoin, is legal in our country and is defined as a special Internet commodity that people can freely buy and sell at their own risk. It is illegal to sell fraud under the guise of bitcoin.

《中华人民共和国刑法》第一百七十六条 【非法吸收公众存款罪】非法吸收公众存款或者变相吸收公众存款，扰乱金融秩序的，处三年以下有期徒刑或者拘役，并处或者单处罚金;数额巨大或者有其他严重情节的，处三年以上十年以下有期徒刑，并处罚金;数额特别巨大或者有其他特别严重情节的，处十年以上有期徒刑，并处罚金。
单位犯前款罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，依照前款的规定处罚。
有前两款行为，在提起公诉前积极退赃退赔，减少损害结果发生的，可以从轻或者减轻处罚。Article 176 of the Criminal Code of the People's Republic of China states that if [the offence of illegal appropriation of public deposits] illegally absorbs public deposits or disguised public deposits and disturbs the financial order, the penalty shall be imprisonment for a term not exceeding three years or detention and a fine or a single fine; if the amount is substantial or other serious circumstances, the penalty shall be imprisonment for a term not exceeding three years or ten years and a fine; if the amount is particularly large or other particularly serious circumstances, the penalty shall be imprisonment for a term not exceeding ten years and a fine shall be imposed on the unit for the offence.
